So I am pretty bad at art so I tend to use other premade sprites. However, I dont know how I can protect myself legally if I use these sprites
For example I want to use this sprite:

It says I cant use it for commercial use, but I see people asking whether they can use it in their free games and he/she says yes.
If I want to use that sprite, what is the best legal way to do it?
I would contact the artists and ask for permission as well as asking what (if any) credit they would want.
Like appletreeman says, its always good to have some written ‘evidence’ in case of whatever down the road.
I agree with both, get permission, get it signed on a real document (best) or at least an electronic agreement (OK) like a signed PDF, not just an email (useless).
Yah I mean I’m not selling the person’s art, I’m just using it for the game. The only way I make money out of it is ads. I think I would just contact the artist. And get a confirmation.
Using it in your game to make money is equivalent to selling his or her art.
Please do not be nonchalant about using others’ efforts to make profit.
The clause the author has in place is explicitly there so people do not make money off the authors work (without permission).
Regarding permission, getting an OK via email really won’t protect you much if you have to go to court later. You’re better off with a physical document or at the very least an electronically signed one.
