A game I am working on follows this concept. There is a button to hear the melody, and the object of the game is to order the notes to match the melody.
The melody you can hear by touching a button is produced by individual samples of instruments. No sampling of original recordings was done, nor any lyrics appear in the game. The melodies are anywhere from 9 to 25 notes. However, what you hear are easily recognizable songs from classical music to modern tunes.
My question is this: does this use of notes from songs falls under “fair use” or if I would be violating copyright law?
Just to repeat and clarify, what you hear in the game are samples of instruments, like a piano, arranged as notes to play back well-know melodies, such as “Eternal Flame”.
