where does the similarity end? It was *inspired* by Fruit Ninja and it was MIT open source code, not that it was making anyone money.
However did the guys go after the schmuck that just compiled the samples and sold them on his site?

yes, seems they’re doing a the-tetris-company-move. not nice.
sure, it was clearly a rip-off. but it was for learning purposes. there MUST have been some geniuses who just compiled and published it - shame on them!
Clones are okay and perfectly legal, because you can’t trademark game mechanics (although TTC does not agree but who wants to make a tetris clone anyway?). So maybe someone should change the graphics and re-upload it as “The Sandwich Samurai Tutorial Project” under a CC license that excludes commercial use… just my 2ct.

Actually, it’s been proven in court that you can trademark game mechanics.
Sega, for instance, has trademarked the use of a floating arrow to direct a player. If you use a similar mechanic (say, a floating hand pointing in the right direction), Sega can and probably will sue you, and due to precedents, will likely win. @x2495iiii well… you mean the case Crazy Taxy vs. Simpsons Road Rage, huh? Sega was a patent troll here. Just like TTC is. And the patent is not the arrow alone, but the mini-map and jumping pedestrians, too - Road Rage also has all of that so the “look and feel” was quite the same.
But imagine a world where id Software holds the patent for first person shooters or where EA is the only company that is allowed to make racing games. No, that would be plain wrong. In my opinion patents in general are wrong!
Again: imagine a world where the first cave men had a patent on hand axes. bye bye civilization.

yes we got informed we had to take down the source and we obliged.
and yes, some folks decided to sell an app without any mods to the template.
thank you all for your understanding and please, due to legal matters, i can’t openly discuss any further.
stuff like this is bound to happen and we must make the best we can out of it.
lets just keep our heads up and we will continue to develop templates for learning and we just gotta keep plowing ahead.

Wow, that’s sad. I wish you had been able to stand up to them because that sets a bad precedent. Source code should be safe from just about anything – it’s only when it’s compiled and distributed that Halfbrick should care. And then they should go after the company that distributed the app, not the source publisher.
Yeah, who wants to get involved in a legal battle? But at the same time, who wants to let a playground bully push people around and get away with it?
I used to like Halfbrick and what they were doing – now I hope they die (company, not people). Actions like that don’t deserve success.

When does an app stop being as you say “Satire”? Greedy Bugs from this user is a direct (including graphics, and *Title* screen) copy of a *copyrighted* game from Ultimate Play The Game, now called Rare (a UK Based game studio). They have even copied BubbleBall for the Blackberry, graphics, gameplay et al.
So if Somebody made a game similar to Parallax and sold it for free, Copying the graphics in it; then Canupa, would you still be claiming that the person that would have made it would have been making a “Satire”??
Let’s stop fooling ourselves on satires and spoofs. All work takes a decent amount of time and effort, and just because you pick on the largest selling game, does not make things “satire”…it’s criminal and unethical.
This is the reason why now people are even patenting the names and words, etc
